Terms and conditions of warranty of NOXON MEDIA GmbH

NOXON MEDIA GmbH ("NOXON") warrants that the hardware sold to end customers within the European Economic Community is and will remain free from material or processing defects given normal use within the warranty period.

The warranty period of 24 or 36 months is taken from the information supplied with the hardware. The warranty period begins on the date of purchase. Services under the warranty will only be provided if the original product is submitted within the warranty period, together with the original invoice or till receipt, stating the purchase date, details of the model and name of the dealer.

In the first instance please notify a warranty claim to your dealer, with whom you have a contract. The dealer shall be obliged to examine the goods and where appropriate, replace them or send them for repair.

If your dealer is no longer available to honour the contract, please contact TerraTec technical support. You must speak to one of our service staff before sending us any items. They will give you an RMA (= Return Material Authorisation) number and information on how to proceed further to return your defective product. Products will not be accepted for repair without an original receipt of purchase and a relevant RMA number.

This warranty does not cover the cost of transporting your product to NOXON, nor any risks associated with transport.

The limited warranty applies beyond the original purchaser to any subsequent owner, provided that, if a claim is made under this warranty, the original receipt can be produced as proof of purchase and entitlement to the warranty claims.

Should defects to the product caused by material or processing defects (present on first acquisition) become apparent during the warranty period, NOXON shall, within the scope of application of the warranty, repair the product subject to the following terms and conditions, without charging for the cost of labour and materials, or (at the discretion of NOXON) replace the product itself or any defective parts. NOXON may replace defective products or parts with new or as-new products or parts. All replaced products and parts become the property of NOXON.

In respect of the system software provided by NOXON, the company warrants that the data carriers, e.g. floppy disks, CD-ROMs and DVDs on which the software is supplied are free from material and processing defects for a period of 90 days after they were first sold to the end user. If defective data carriers are supplied, NOXON will replace them free of charge. Apart from the warranty in respect of data carriers, all software is supplied without express warranty. NOXON makes no assurance that this software will operate without interruption or defects or be sufficient for your requirements.

This warranty does not cover the following:

1. The regular maintenance and repair or replacement of parts caused by normal wear;
2. Compatibility problems arising from the hardware and software or another configuration or technical environment in which the unit is operated;
3. Non-durable goods (components which are expected to need replacing regularly during the lifetime of the product, for example non-rechargeable batteries, light bulbs, etc.);
4. Damage or defects caused by use, operation or handling of the product which may not be deemed normal private use;
5. Damage or changes to the product caused by:

a. Improper use, including
- handling which results in physical or surface damage or appearance defects to the product or damage to the liquid crystal display;
- connection or use of the product for a use other than its intended use, or failure to observe the NOXON operating and installation instructions;
- failure to observe the NOXON care and maintenance instructions when maintaining and caring for the product;
- connection or use of the product in contravention of the applicable technical or safety regulations of the country in which the product is used;
b. Virus infections or use of the product with software that was not supplied with the product or not installed correctly;
c. Use of the product in systems or under conditions not intended for the use of the product, with the exception of other TerraTec products intended for use with the product;
d. The use of the product with accessories, additional appliances and other products, the type, condition or standard of which are not authorised by NOXON;
e. Repairs or attempted repairs by persons not belonging to NOXON;
f. Adaptations or modifications without the prior written consent of NOXON, including
- upgrades to the product beyond the specifications or features described in the operating instructions;
- modifications to the product to adapt it to comply with the national or local technical or safety standards of countries other than those for which the product was specially designed and manufactured;
- negligence;
- accidents, fire, fluids, chemicals, other substances, flooding, earth tremors, excessive heat, inadequate ventilation, sudden voltage spikes, excessive or reversed current or input voltage, electrostatic discharges (including lightning strikes), other external forces and influences.

Warranty exclusions and limitations
With the exception of the points referred to above, NOXON makes no express, tacit, legal or other warranties in respect of the quality, performance, precision, reliability, suitability for a specific purpose or other properties of the product, its accompanying software or software that is a component part of the product. If this exclusion is not permissible, or only to a limited extent, under the applicable law, NOXON shall exclude its warranty services to the extent allowed by the applicable law, or limit them to the minimum permitted by the applicable law. Any warranty that cannot be fully excluded shall be limited to the duration of this warranty, provided this is permitted by the applicable law.


NOXON's sole obligation under this warranty is the repair or replacement of products covered by the terms of this warranty. NOXON shall not be liable for losses or damage incurred in connection with products or services provided under this warranty or other losses or damage, including financial or intangible losses, the purchase price of the product, loss of profits, income, data or the use of the product or a connected product, indirect or accidental loss or damage or consequential losses. This is regardless of whether such loss or damage are in connection with

1. Adverse effects or inoperability of the product or a connected product due to defects or unavailability while it is at NOXON, leading to a stoppage, loss of availability to the user or an interruption to the user's business operations;
2. Imprecision in the results produced by the product or connected products;
3. Damage or loss of software programs or removable data storage media;
4. Infections by computer viruses and other causes.

This limitation of liability applies to losses and damage whatever the legal cause, including negligence and impermissible actions, breach of contract, express or tacit warranties and absolute liability (even if NOXON were informed of the possibility of such damage or losses).

If the applicable law forbids or limits these limitations of liability, NOXON shall exclude its liability only to the extent allowed by the applicable law, or limit them to the minimum permitted by the applicable law. For example, some countries forbid the exclusion or limitation of liability due to negligence, gross negligence, deliberate misconduct, fraud and similar actions. NOXON's liability under this warranty shall not in any circumstances exceed the purchase price of the product. If the applicable law only allows higher liability limits, these higher liability limits shall be applied.

Safeguarding your statutory rights
Users have statutory rights under the national laws in connection with the sale of consumer goods. This warranty does not affect any possible legal claims to which you are entitled, nor those rights that may not be excluded or limited, nor any legal claims against the persons from whom you have bought the product. You may at your own discretion make all the claims to which you are entitled.
